Cases Against Manufacturer of Alleged Defective Hernia Patch Consolidated in Rhode Island

The Kugel Mesh Hernia Patch, was recalled because hundreds of individuals were hurt as a result of using the device. The patch was supposed to help give hernia patients relief from their pain. By 2005, however, it was clear that there was something wrong with the patch. It appears that the recoil ring that opens the patch can break. When the ring breaks, users suffer from bowel perforations and other serious problems. The damage was so severe to the patients, the Food and Drug Administration issued a recall of the patch and warned doctors not to prescribe it. The FDA also contacted individuals who were using the device and encouraged them to seek out medical attention if they were having any problems.

Hundreds have been injured resulting in a numerous legal actions being brought against the manufacturer of the patch, Davol, Inc. and its parent company. D.R. Bard, Inc. In fact, there were so many cases brought across the country due to this defective product, that all cases brought in federal court in the country were consolidated and transferred to Rhode Island for pre-trial matters.
