Mandatory Helmet Law Controversial in South Carolina

Currently, if you are under the age of twenty-one (21), you must wear a helmet when riding a motorcycle in South Carolina. Bikers older than twenty-one (21), however, are not required to wear them. Unfortunately, the older bikers are no more immune to head injuries caused as a result of motorcycle accidents than those under the age of twenty-one (21).

The head injuries are often fatal. Those that are not fatal, often result in some sort of brain injury, often causing permanent impairment.

Those who argue against mandatory helmet laws in South Carolina state that they should have the freedom to choose whether to wear one. South Carolina is not alone, however. Twenty-three (23) states allow anyone eighteen (18) years of age or older to ride a motorcycle without a helmet. South Carolina is one (1) of seven (7) states that requires those under twenty-one (21) years of age to wear a helmet.
