In December of 2005, Keith Scofield ordered an over-the counter drug from a Wal-Mart pharmacy in Frederick, Maryland. Mr. Schofield ordered Humulin R (u-100). Instead, Mr. Schofield was puportedly given Humulin R (u-500). Humulin R (u-500) is a prescription drug that has five times more the insulin of the medication that Mr. Schofield requested from the pharmacy.

According to his family who filed a lawsuit against Wal-Mart for wrongful death on behalf of the estate, Mr. Schofield injected the insulin several days later in December 2005, and went into a diabetic coma. He died in January 2006.

The lawsuit was settled through mediation without having to go to court. The case was settled without any admission by Wal-Mart as to liability or fault.
